Application Timeline

 

 

When to file an application

 

1. In the event of the joint body's recommendations being favourable an application to the Tribunal may filed within 90 days reckoned from the date of the communication of such rejection if the Secretary-General:

 

(a)           has rejected the recommendations;

(b)           failed to take any action within thirty days following the communication of the opinion;

(c)           failed to carry out the recommendations within thirty days following the communication of the joint body's opinion.

 

 

2. In the event that the recommendations made by the joint body are unfavourable to the applicant, an application may be filed:

 

(a)           either within 90 days reckoned from the date of the communication of the joint body's opinion containing recommendations unfavourable to the applicant; or

(b)           within 90 days reckoned from the date of the communication of their acceptance by the Secretary-General.

 

An application shall not be receivable if the joint body unanimously considers that it is frivolous.

 

 

3. In the event that the Secretary-General and the applicant have agreed to submit the application directly to the Tribunal in accordance with the option given to them under article 7, paragraph 1, of the Statute, the filing shall take place within 90 days of the date on which the Secretary-General notifies the applicant of his agreement to direct submission.
